1. Introduction
Welcome to DisputeDesk. These Terms of Service ("Terms") govern your use of the DisputeDesk website and service (collectively, the "Service"), operated by Solution Blue Pty Ltd (ABN 26 660 646 801), a company incorporated in Australia with its registered office in Forster, NSW, Australia ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
2. Description of Service
DisputeDesk provides AI-generated dispute letters and related tools for consumers and small businesses to assist with responding to fake online reviews, chargebacks, and other disputes. The Service is intended to help you draft professional correspondence; it does not constitute legal advice, and we are not a law firm. No solicitor-client relationship is created by your use of the Service.
3. Eligibility
You must be at least 18 years old and capable of entering into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements.
4. Accounts and Registration
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscription and Billing
DisputeDesk operates on a subscription basis. Fees are charged in advance on a recurring monthly basis. We offer a 14-day free trial; you will not be charged until the trial period ends. You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of the current billing period. No refunds will be provided for partial months. All prices are in Australian Dollars (AUD) unless otherwise stated and are inclusive of GST where applicable.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to generate fraudulent, defamatory, or harassing content;
- Attempt to gain unauthorised access to the Service or its systems;
- Reverse engineer, decompile, or disassemble any aspect of the Service;
- Use the Service in a manner that could damage, disable, or impair our servers or networks;
- Resell, sublicense, or commercially exploit the Service without our prior written consent.
7. Intellectual Property
All content, software, and materials provided through the Service, including but not limited to text, graphics, logos, and code, are owned by or licensed to Solution Blue Pty Ltd and are protected by Australian and international intellectual property laws. Dispute-generated letters and content created through your use of the Service are your property; however, you grant us a limited licence to process such content solely for the purpose of providing the Service.
8. Disclaimer and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Solution Blue Pty Ltd disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the Service will be accurate or reliable. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be excluded.
To the maximum extent permitted by law, our total liability to you for any claims arising out of or relating to these Terms or the Service will not exceed the total amount you have paid us in the 12 months preceding the event giving rise to liability.
9. Indemnity
You agree to indemnify and hold harmless Solution Blue Pty Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive, including but not limited to intellectual property rights, disclaimers, indemnity, and limitations of liability.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.
12. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on this page. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the change becoming effective. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
